Slip and Fall on Wet Wooden Staircase Results in Negligence Lawsuit

A man slipped and fell on some wet wooden stairs in a New Orleans business and is now suing the defendant for his injuries. The defendant in the case is Martin Midstream, according to a report in louisianarecord.com. Martin removed the case to New Orleans federal court last month.

According to the negligence complaint, the plaintiff was walking down a flight of stairs at Martin Midstream in June 2010. The wooden steps were wet and he fell to the ground. He claims he suffered a serious injury to his left knee in the accident. At the time of his fall, there was not a handrail on the wall alongside the staircase, according to the complaint.

The plaintiff says Martin is negligent for allowing water to remain on the steps, failing to maintain the steps in a safe condition, failing to inspect the premises, failing to have non-slip material on the steps, failing to warn him of the unsafe condition and failing to install a handrail alongside the steps.
