Louisiana Appeals Court Upholds $3.8 Million Asbestos Judgment

A recent report in the Washington Examiner highlighted a case involving a company appealing a judgment handed down in a Louisiana asbestos exposure case. The company, Entergy Gulf States Louisiana, LLC, was left on the hook for $3.8 million by the judgment and sought to have it overturned, citing that “the lower court erred by considering the surviving plaintiffs’ own pain and suffering in a survival action.”

However, the Louisiana First Circuit Court of Appeal did not agree with Entergy’s argument, choosing instead to affirm the lower court’s decision of a $3.8 million judgment in favor of the plaintiffs, who had sued on behalf a family member who had worked for Entergy from 1955 to 1974.

While working for Entergy, the plaintiffs’ family member was allegedly exposed to asbestos, which caused him to develop mesothelioma. He died of mesothelioma in August of 2011.
