Researchers recently released the results of a study involving three states that toughened their standard for malpractice in the emergency room to gross negligence. According to the Insurance Journal, as a result of their study, the researchers concluded that malpractice reform did not equal less-expensive medical care.

The researchers found that even though many doctors said that they order unnecessary tests because they are afraid of being sued, that was not the whole story. When doctors order unnecessary tests to protect themselves, it is known as defensive medicine, which has been cited as a major contributing factor to rising healthcare costs.

“These malpractice reforms have been said to provide virtual immunity against lawsuits,” said Dr. Daniel A. Waxman, the study’s lead author. However, according to the research done by Waxman and his team, “even when the risk of being sued for malpractice decreases, the path of least resistance still may favor resource-intensive care.”
