Bereaved Daughter Sues Home Care Worker for Medical Malpractice

A grieving daughter is suing a healthcare provider at Lakeside Hospice, accusing her and the nursing home of medical malpractice.

The woman claims she hired Lakeside Hospice to care for her ailing mother. The hospice had agreed to send healthcare workers to her house to perform end-of-life care in July 2013.

According to the plaintiff, the home care workers Lakeside provided were problematic from the start. They often canceled with little to no notice, instead giving the patient’s daughter instructions on how to care for her over the phone.

Additionally, the daughter says the caretakers removed the labels from her mother’s medications, replacing them with handwritten labels. She says her mother died shortly after the hospice center started managing her care.

The company’s poor behavior continued after the woman’s death. The employee Lakeside dispatched to console the victim’s family neglected the family and the woman’s body, focusing instead on confiscating medication.

The facility also held on to the patient’s death certificate for 4-5 days, which kept the victim’s body from being embalmed in a timely fashion. The daughter’s lawsuit seeks unspecified damages for emotional distress, mental anguish and attorney’s fees.

We trust nursing homes and hospices to care for our ailing loved ones, but negligence and abuse at these facilities are far too common. When carelessness causes harm, an experienced elder care attorney can help with a medical malpractice suit to help hold the right people responsible.
